November 5, 2008. Seven artists associations including SAA have joined together in an amicus curiae brief in support of photographer Jerry Greenberg's Supreme Court appeal of the latest decision that sided with National Geographic.
The brief, prepared by the American Society of Media Photographers, supports Greenberg's position that the magazine is infringing his copyright by republishing some of his images as part of a CD compilation, without compensation for this additional use. The brief urges to court not to "divest freelance creators of their rights in new collections of previously published works."
In filing the amicus brief, SAA joined the American Society of Media Photographers, the Graphic Artists Guild, the North American Nature Photography Association, the Advertising Photographers of America, and the Picture Archive Council of America.
NPPA general counsel Mickey H. Osterreicher comments that NPPA "believes that creators of copyrightable works that are subsequently used in collective works are already being exploited by publishers and should not be further taken advantage of by those publishers by being denied their rightful share of the profits from those works."
